What activities require an active Texas real estate license?

An active texas real estate license is mandatory for every person who performs activities related to the real estate industry for other person in lieu of monetary consideration. The real estate practices in Texas include the following:

  • buying, selling, exchanging and leasing real estate
  • offering to buy, sell, exchange or lease real estate
  • negotiating or making an attempt to negotiate buying, selling and leasing of real estate
  • listing, attempting to negotiate listing, buying, selling or exchanging real estate
  • offering, appraising, or attempting to appraise real estate
  • auctioning, or agreeing or attempting to auction real estate
  • helping or offering to help in buying or leasing real estate
  • procuring, or helping in procuring properties for selling, leasing or exchanging real estate
  • buying, selling, exchanging or leasing an easement or right-of-way for their usage in anything related to telecommunication, pipeline services, railroad or utility.


    The right-of-way agents need to have an active license, else they must be registered with the TREC for their practice. Apart from the listed activities, an active license is also required by any person who sells a land, either in whole or in part, for the owner in lieu of any fee, salary, commission, or any valuable consideration. An active license is also required by any person who charges fees in advance for promoting a real estate sale. The same is applicable for a person who collects a fee under any contract relating to the sale of real estate.
